1615. Evidence of Current Ability to Manage Benefit Payments

1615.1 When should a beneficiary submit evidence of capability?

Whenever a beneficiary, age 18 or over is receiving payments through a payee and believes he/she is now able to manage benefit payments, he or she should submit evidence of capability.

1615.2 What evidence must be submitted?

The beneficiary may submit:

1. A signed statement from a physician or from a medical officer of the institution where he or she is or was confined, showing the beneficiary's present capability of managing funds (see §1607);

2. Other evidence that establishes the beneficiary's ability to manage or direct the management of funds; or

3. A certified copy of the court order restoring the beneficiary's rights in a case where he or she was found legally incompetent.
