If a person died after January 2009 and was collecting SS up until then, isn't his estate entitled to the $250.00?

In your scenario, it seems unlikely the estate would receive the $250 payment.
The Social Security web site has the following :
Q. What do I do if I need to return a one-time economic recovery check (for example, because the intended recipient died before cashing it)?
A. You should return the check to your local Social Security office. The office will provide you with a receipt to document that you returned the check.
